The battle of rights between Delhi government and the Lt. Governor has taken a new turn as both the judges of the bench- AK Sikri and Ashok Bhushan were not unanimous on the transfer and appointment of Joint Secretary Level officials. Due to conflict of interest, the matter has been referred to a larger bench.
Justice Bhushan had disagreed on one point of the verdict read out by Justice Sikri. The judgement made by the Supreme Court had some decisions called out loud and clear deciding the rights between Delhi and Centre.
The Anti-corruption Bureau will remain with the central government.
The appointment of a government lawyer will be with the Delhi government.
The Commission of enquiry will remain under the central government.
The Delhi government will decide the circle rate for the land in Delhi. Electricity Board will remain with the Delhi Government.
When there is a dispute between LG and the Chief Minister, LG's opinion will be considered.
On the verdict of Supreme Court, the Delhi CM Kejriwal expressed his disappoinment saying that "if a government can not even transfer its officials, how can they work? The party which has 67 seats does not have the right, but the party which has won three seats has the right."
