Munawar Faruqui, who was arrested for cracking a jokethat he allegedly didn't crack got ad-interim bail from the apex court of Indiaafter spending nearly 35 days in prison. He was detained for alleged 'indecentjokes' about Gods and Goddesses of Hindu religion and Union Home Minister, AmitShah.
According to NDTV, the authorities at the Indore jailbefore Faruqui's release had told that they didn't get any order from theSupreme Court. Faruqui, while speaking to the NDTV said, "The matter issubjudice before the court and I have full faith in the administration ofjustice and I would not like to make any comment at this stage."
Faruqui gets bail by a three-judge bench led by JusticeRohinton Fali Nariman. The bench also stayed a production warrrant issued bythe Uttar Pradesh government against the comic.
The bench ordered, "The petitioner is released onad-interim bail on conditions to the satisfaction of the trial court. In themeantime there shall be stay of the production warrants as well."
The allegations against Faruqui are vague, as per JusticeNariman. He also observed that the Police didn't comply with the lawful procedureprescribed under section 41 of CrPC.
Faruqui is accused of hurting religious sentiments.Justice Nariman asked, "tell us, Mr Kirpal, did the police follow Section41 before they arrested him?" Mr Kirpla while responding to the JusticeNariman said, "No, My Lord....not at all."
Justice Nariman granted Faruqui bail before issuing anotice to Madhya Pradesh police for their actions regarding not followingSection 41.
