Prime time TV show video-clip helps in granting bail to 3 accused in Riots case

Advocate Salim Malik appearing for the petitioner argued that the three accused were not seen in the video that the prosecutor has relied on.

Prime Time with Ravish Kumar is a prominent show on NDTV.The video of the show comes to the rescue of three accused in Delhi riots case.

The Delhi High Court observed, "there is no evidencewhatsoever, either direct or circumstantial or forensic" against threepersons while relying on the prime time show of Ravish Kumar.

Junaid, Chand Mohammad and Irshad were accused in thekilling of Shahid during February 2020 riots. They were behind bars since Aprillast year.

The police had claimed that these three accused were partof a Muslim group for attacking the Hindu group. The Muslim group was presentat the Saptrishi building at Chand Bagh area of North East Delhi. The Hindugroup was present at rooftops of other buildings.

Shahid got killed by a gun shot. He was present atSaptrishi building.

The video of NDTV's Prime Time was played where thepetitioners were not seen in it. A single judge bench of Justice Suresh KumarKait observed that it was a long range shot and not a close range.

Justice Kait observed, "It is pertinent to mentionhere that in the post-mortem report, the direction of the wound in which it hasentered the body has been given to be from the left side which is goingdownwards and exiting from the right side. Which means that  the injury was from height and at a distantrange, thus, establishing the possibility that the bullet came from MohanNursing Home or any building which is on the left side of the Saptrishibuilding and is on more height than that of Saptrishi building."

Justice Kait further observed that a man wearing helmetwas firing from Mohan Nursing Home. The court after making certain observationsordered the release of accused on bail.
