The Punjab government has allowed registered shops and commercial establishments across the state to remain open 24 hours a day, seven days a week, subject to prescribed conditions. The decision means shops that meet the required conditions can operate round the clock instead of being bound by conventional opening and closing hours. However, the exemption comes with responsibilities related to workers’ safety, working hours and other labour-law requirements.

No 24-hour shift for employees

The permission for establishments to remain open 24x7 does not mean employees can be made to work continuously for 24 hours. The report specifically states that the relaxation applies to the opening and closing hours of establishments, while employees will continue to be governed by prescribed working-hour limits under labour laws. Employers must provide required breaks, weekly rest and other statutory protections, and cannot treat the 24x7 permission as a 24-hour work shift for individual workers.

New rules focus on women’s safety and labour compliance

The notification lays down specific conditions for establishments employing women, including requirements related to their safety. Employers will have to ensure proper arrangements for women employees working during late-night or overnight shifts.

The rules also require compliance with applicable provisions concerning employees’ working hours, rest intervals and other protections under labour laws. The exemption to operate 24x7 can be withdrawn if an establishment violates the prescribed conditions.

Child labour rules remain applicable

The 24x7 permission does not override existing restrictions concerning child labour. Establishments will continue to be required to comply with provisions of the Child Labour (Prohibition and Regulation) Act, 1986.

The government has also made it clear that round-the-clock operation does not mean businesses can ignore other statutory requirements. Establishments will have to follow the applicable labour and employment regulations while availing themselves of the exemption.

Police and administration responsible for enforcement

The report also highlights the role of the police and administration in ensuring compliance with the conditions. Authorities can take action if establishments fail to provide the required safety arrangements or violate the terms under which they have been permitted to operate 24x7.
