Canadian permits for students and workers to arrive by postal mail

The Immigration, Refugees and Citizenship Canada (IRCC) department has opened up its web form to accept requests for processing permits for individuals who have their Letter of Introductions (LOIs). Those who have received their LOI under International Experience Canada program are also eligible to apply under the same.

Due to the pandemic COVID-19 and its consequent restrictions on travel, any non-critical travel has been forbidden. Thus, the process of physically visiting a port of entry to present LOI and getting it processed to a legal permit was not possible. And legally working until the permit was in hand was not possible. This catch-22 situation has been resolved with the use of Internet and postal mail.

The deadline for this process of requesting work or study permit online and receiving it in physical mail is open till March 31, 2021 only. The process is slightly different for students and workers. The aim of the process is verification.

For students, the study permit application will be evaluated, and the name of the Designated Learning Institution will be matched with the LOI. Then, checks will be made with the applicant’s school to see if the foreign students are being accepted at the moment and the study program of the applicant is still active. Also, funds for accommodation, tuition, living expense, and for return home will be confirmed.

For workers, a similar check i.e. matching the name of employer in the Labor Market Impact Assessment (LMIA) or LMIA-exempt offer with the application is performed. Any cause for concerns noted is also looked into. Further, the job offer will be confirmed with the employer and arrange an interview if they think is required. Any public information can also be used to confirm the employer and any information that leads the officers to refuse the permit will have to be followed by the procedural fairness process.

 To be fair to both the parties, in case of refusal, the officers must add case notes and the rationale and the grounds of refusal of the application. Also, advice on the next steps, expiry of the status, and other details will be intimated.

For those whose applications will be approved can study or work legally in Canada, once they receive their documents in postal mail.
