Delhi HC refuses to hear plea against 'media trial' of Wrestler Sushil Kumar

A bench comprising Chief Justice D N Patel and Justice Jyoti Singh said Kumar is a "vigilant person" and the court cannot entertain a PIL on his behalf.

TheDelhi High Court on Friday refused to entertain a plea seeking to restrain themedia from sensationalising Olympic medallist Sushil Kumar's trial inconnection with the murder of a 23-year-old wrestler.

Abench comprising Chief Justice D N Patel and Justice Jyoti Singh said Kumar isa "vigilant person" and the court cannot entertain a PIL on hisbehalf.

Disposingof the plea filed by a law student, the bench said: "Let that mancome...We see no reason to entertain litigation on behalf of a vigilant person.

Theplea claimed that Kumar's career and reputation was tarnished by the mediareporting against him in connection with the Chhatrasal Stadium brawl that ledto the death of a wrestler.

Accordingto the plea, the excessive publicity of the suspect in the media before thetrial in a court of law, either incriminates a fair trial or results incharacterizing the suspect as the one who has certainly committed the crime.

Theplea added that this amounts to undue interference with the"administration of justice", and sought proceedings against the mediafor contempt of court.

ADelhi court on May 23, sent the Olympic medallist to six days police custody.

Accordingto the police, Kumar and his associates allegedly assaulted fellow wrestlerSagar Dhankar and his two friends Sonu and Amit Kumar at the stadium on May 4night. Dhankar succumbed to his injuries later.

TheDelhi Police have filed an FIR under Sections 302 (murder), 308 (culpablehomicide), 365 (kidnapping), 325 (causing grievous hurt), 323 (voluntarilycausing hurt), 341 (wrongful restraint) and 506 (criminal intimidation) of theIndian Penal Code. They have also included Sections 269 (negligent act likelyto spread infection of disease), 120-B (criminal conspiracy) and 34 (commonintention) of IPC and various sections under the Arms Act.
