SC expresses shock over HC order on protection to ex-Punjab DGP, terms it ‘unprecedented’

Supreme Court bench asked HC Chief Justice to decide on Ex-Punjab DGP plea within two weeks

The Supreme Court on Fridayexpressed shock over the unprecedented decision of Punjab and Haryana HighCourt for protecting Ex-Punjab DGP Sumedh Singh Saini in all future cases. TheChief Justice of India along with other justice asked the High Court ChiefJustice to decide his plea within two weeks himself or by another judge.

On Thursday the High Courtextended the stay on the arrest of Sumedh Singh Saini in all cases pending on him,except Balwant Singh Multani’s murder case till April 20. 

Regardingthe matter, the bench said, “This is an unprecedented order. How can a futurecourse of action be stayed? It is shocking and three of us (judges) feel thatit is unprecedented. This will require a hearing.” 

Addingto it, Chief Justice Ramana said, “We will request the high court to dispose ofthe petition…by another judge and not the same judge within two weeks. Werequest the Chief Justice to take it up himself or by any other judge…we willkeep this matter pending.”

TheSupreme Court had granted protection to Saini from arrest in the Balwant SinghMultani Murder case on 15 September 2020. Court asked Saini to co-operate himwith the Punjab Police Protection. The Senior Advocate Mukul Rohatgi told thebench that there have been attempts of arrest by Punjab Police on Saini.
