Germany on April 1, 2024, became one of the few countries to pass the new marijuana law decriminalising smoking and growing weed up to a certain extent. Under Germany's new cannabis law, smokers can not only keep weed with themselves but also grow their cannabis plants at their homes. However, Germany's new weed law is said to partially decriminalising weed as it has put a few limitations. Germany legalised Marijuana so that it can reduce the black market and protect smokers from the harmful effects of contaminated cannabis. While a section is celebrating Germany's decriminalising Marijuana ban, a section of medical professionals have flagged the harmful effects of marijuana on people, particularly the youth whose brains are still developing and are more vulnerable to addiction. Now, the question arises what is Germany's new marijuana law and how much weed German's can keep with themselves? Below is everything you need to know- 

Germany's new marijuana law explained point-by-point

Germany’s new marijuana law was passed by the country’s  Parliament in March 2024. The law includes the following- 

  1. Those above 18 years of age can smoke marijuana
  2. They can carry 25 grams of cannabis
  3. They can grow three cannabis plants per household

Notably, Germany's new cannabis law also bans people from smoking cannabis within sight of schools, sports centres, or in 'pedestrian zones' from 7 am to 8 pm. The controversial will be implemented in phases. While the smoking, possession, and growing of cannabis is legal from Monday, marijuana growers’ associations may only be formed after July 1. 

Marijuana growers and users' clubs will be governed by the following norms- 

  • They may have up to 500 members
  • They may grow cannabis and distribute marijuana on not-for-profit basis
  • Only Germany’s residents may be members of these clubs
  • While the distribution of marijuana will be allowed, the consumption within the premises will be barred
  • A member will be allowed to procure a maximum of 50 grams of cannabis a month

The law legalising marijuana usage is being called the ‘first pillar’ of the two-step plan in Germany. As per Politico, the proposed ‘second pillar’ of the plan comprises the setting up of municipal five-year pilot programmes for state-controlled sale of cannabis in licensed shops.
