Maharashtra Police moves Session Court challenging CJM's order of judicial custody of Arnab Goswami

The police, in its application, said the CJM court at Alibaug had erred in not considering the submissions and grounds submitted by the prosecution while seeking custody of Goswami

Republic Chief Arnab Goswami's arrest has already created huge uproar across India and questions are being raised on the Maharashtra State government. On Wednesday,  the Maharashtra Police's Raigad unit on Wednesday morning raided the home of Republic TV owner and arrested its Chief Editor Arnab Goswami in an abetment to suicide case.

Mumbai Police moves Session Court challenging CJM's order of judicial custody of Arnab Goswami a team of over a dozen senior police officials from Mumbai and Raigad, several of them armed -- led by former ‘encounter specialist' and now with the elite Crime Intelligence Unit (CIU) Sachin Vaze -- descended on his Worli home in Raheja Complex to pick him up.

Arnab was taken to Alibag, around 90 km from Mumbai, and was produced in a court.  The hearing went on till late night on Wednesday. Police had sought Goswami’s custody for 14 days, but the court held that custodial interrogation was not required.

Now, the Alibaug police in Raigad district on Thursday filed a revision application before a sessions court challenging the order passed by a lower court remanding Republic TV Editor-in-Chief Arnab Goswami and two others to judicial custody in abetment of suicide case.

The police, in its application, said the CJM court at Alibaug had erred in not considering the submissions and grounds submitted by the prosecution while seeking custody of Goswami and two other arrested accused Feroze Shaikh and Nitesh Sarda.

It is to be noted that the CJM Pingle had termed Arnab Goswami's arrest illegal and therefore sent him judicial custody rather than Police custody. 

"Taking into consideration the reasons behind the arrest of the accused persons and the arguments put forth by the accused persons, the arrest appears to be prima facie illegal," the CJM had said.
