Following up on its hints yesterday, the Supreme Court went ahead and stayed the three farm laws. Further, the Court observed that it is extremely disappointed on the efficacy of the ongoing negotiations.  Also, a committee will be constituted which will be headed by a former Chief Justice of India to resolve the deadlock.

12 Jan 2021, 2:08 PM: 

The CJI observed that they are passing the orders to suspension of the three farm laws. The laws remain stayed till further orders. Next, a committee shall be formed with experts of agricultural, and agricultural experts. 


12 Jan 2021, 2:01 PM: 

The SG further clarifies to the Supreme Court that other interests have joined the protest and the farmers are being misled into thinking that their lands will be taken away.

The law, if anyone cares to actually look into it, only permits contract farming for the crops grown on the land. There is absolutely no potential for any land being usurped or taken away.

In fact, the law has clear provisions to protect the farmers.

Furthermore, the law prohibits any action against the farmers in case of recovery of dues.


12 Jan 2021, 1:56 PM: 

Bhanu from Bharatiya Kisan Union recommended names of Justice Kurien Jospeh, Justice Markanday Katju to head the expert committee.

He further informed, to the delight of the Supreme Court, that he will submit an undertaking that they will ensure that elders, women, and children will not be a part of future protests.


12 Jan 2021, 1:44 PM: 

The AG requested high security throughout the national capital and raised a possibility of law and order situation if thousands of individuals are allowed to walk into Delhi.

The CJI noted that the same falls under the purview of the police and ended this topic observing that nothing further will be said on the same.


12 Jan 2021, 1:33 PM: 

When enquired that if the government that banned organisations are aiding the protests, the AG clarified that the allegations of protests being infiltrated by banned organisations will be filed with IB reports and affidavit.


12 Jan 2021, 1:20 PM: 

CJI enquires if any farmer association has filed an application with Delhi Police to protest in Ramlila Maidan on January 26. Further he asked if the police can impose conditions on them; and ask them to hold the rally subject to the conditions.


12 Jan 2021, 1:17 PM: 

Harish Salve requested the Supreme Court to note that the Minimum Support Price (MSP) is not going anywhere and further the Court must assure the farmers of the same too.


12 Jan 2021, 1:15 PM: 

Harish Salve requested the Supreme Court to note on record that the suspension of the three farm laws is not a victory for anyone, but a means to resolve the issue.

The Court observes that the suspension is indeed a victory, but a victory for Fairplay.

However, the Court went ahead and expressed they have no difficulty in soothing concerns that no lands will be sold or usurped under the three farm laws.


12 Jan 2021, 1:04 PM: 

Harish Salve observes that the Court is promoting a committee while the farmers have chosen to not appear for the hearing. The CJI observed that the suspension of the three farm laws is not indefinite.


12 Jan 2021, 1:02 PM: 

Dushyant Dave has chosen to miss today’s hearing when he was the one who wanted an adjournment yesterday to discuss the suggestion of a committee yesterday. He asked for the adjournment to clarify with farmers. 

The CJI observed that it be noted that the farmers’ counsels have chosen to give the hearing a miss, in spite of being the largest group of farmers.


12 Jan 2021, 12:56 PM: 

The CJI also noted that the laws cannot be suspended indefinitely though it will have to run parallel to a process for resolution.


12 Jan 2021, 12:54 PM: 

A petitioner from South India informed that widespread agitations have erupted and no support for the laws is present in South India.


12 Jan 2021, 12:52 PM: 

CJI observes that the committee will be better suited and any negotiation between the PM and the farmers will not be a more effective solution.


12 Jan 2021, 12:48 PM: 

The CJI showed some strength and invalidated all farmers and organisations who do not want to make their case in front of the committee.

Further, the CJI suggested that indefinite protests will not be tolerated and neither will the PM be asked to do anything.

The CJI notes that the only way out is the rectification of the problems in the laws.


12 Jan 2021, 12:46 PM: 

The CJI observes the importance of the committee as a guide to the Court on the way forward. Further the Court reminded the lawyers to remain loyal to their profession and not reject any process if it did not suit their agenda.


12 Jan 2021, 12:44 PM: 

The CJI clarifies the intentions of the Supreme Court. He claims that the Court is only concerned with the validity of the laws and some other points.

In addition to the constitutionality of the three laws, the Supreme Court is concerned with protecting the life and property, and to resolve the issue in the best possible way.

To achieve its aims, the Court may suspend the legislation, but it will not be an empty suspension. As suggested by the Court yesterday, an expert committee will be setup and then the responsibility will be handed to the committee.

The Court wants all stakeholders and interested entities to consult with committee which, the Court clarified, is not for punishing anyone but only to find a way out.

12 Jan 2021, 11:00 AM: 

The hearing is delayed, but will be attended to today.


12 Jan 2021, 10:42 AM: 

The hearing is scheduled to begin at 11:30 AM today. Meanwhile, the eighth round of talks between the Centre and the protesting farmers does not seem to bear any fruit.

The farmers are unwilling to discuss their issues with the Centre which wants to learn about the issue of the farmers. The farmers are adamant in their demands to repeal the three farm laws, giving ultimatum that they will die until they get the Centre to accept whatever they want. The farmers are making a show of strength that they will go home only when the laws get repealed.


12 Jan 2021, 10:20 AM: 

Via Delhi Police, the Central Government sought injuction against a proposed tractor rally or any other kind of protest intending to disrupt the Republic Day or the August gathering. 

The Central Government shared information that a small group from the protesting individuals and organisations have decided to carry out a tractor rally on January 26. Consequently, a massive law and order situation will then be at hand.
