After the trial court declined his plea to lead evidenceto prosecute Congress President Sonia Gandhi and  her son Rahul Gandhi among others in aNational Herald case; Bharaitya Janta Party's (BJP) MP, Subramanian Swamy movesDelhi High Court against it.

The trial court had said that Swamy's application under Section244 of CRPC would be considered after his examination in the case. The courtsaid this on February 11.

Swamy through his application had sought summoningwitnesses and directing them to prove certain documents under Section 244 ofthe CrPC.

Swamy has accused Gandhisand others of conspiring by paying Rs 50 lakh, through which Young IndianPrivate limited obtained the rights to recover Rs 90.25 crore that the NationalHerald owner owed to Congress.

The accused have denied the claims of Swamy.
