The two brothers aged 19 and 21, were apprehended for their alleged involvement in producing explicit videos by exploiting AI technology. The latest incident in Palghar has forced the people of India and netizens to think about whether there is any punishment or jail term for the misuse of AI or not. Well, the answer is yes, there are laws in India under which misuse of AI might land you in jail, and also heft fines would be levied on you.

What does the Indian law say over the misuse of AI or obscene video-like incidents?

If the aforementioned-like incident takes place in which AI has been used in making vulgar video of anyone then the person responsible can be booked under various sections of the IT Act, IPC, and Data Protection Law. As per reports, under Section 67 of the IT Act, there is a provision to take action against a person if any objectionable video is posted on the Internet. Under this section, there is a provision of imprisonment for up to three years and also a fine. Notably, this punishment can also be increased. The person whose image gets tarnished by the shared video can also file a defamation case.

What should you do if you are a victim of misuse of AI?

If someone becomes a victim of this type of crime in which misuse of AI is in the play, then you can contact the cybercrime branch and they will register your complaint. As it is said prevention is better than cure, it is also advisable that users need to be a little careful while sharing their photos on social media. If you find your photos on any social media platform without your consent, you can also report there as well. If you find any objectionable video or photo of yours on Facebook then first you can report that and then you can contact customer care and ask them to remove those from the social media.

Notably, there are multiple cases that have come to light that used deep fakes, and morph videos. Notably, AI has made the boundaries between real and fake even more thin. For instance, the world media had become the victim of AI fraud when they flashed news saying that the Pentagon was on fire after an alleged attack. However, later it was revealed that the images were AI-generated and the entire world became a victim of fake news.
