The National Commission for Scheduled Castes (NCSC) on Monday directed Punjab authorities to take immediate steps for the arrest of Punjab Pradesh Congress Committee (PPCC) chief Amarinder Singh Raja Warring within five days in connection with alleged derogatory remarks made against late former Union Home Minister Buta Singh during an election rally in Tarn Taran.
The Commission, chaired by Kishor Makwana, expressed serious concern over the delay in the investigation and arrest, despite specific recommendations issued during an earlier hearing on May 5. It also noted that the Action Taken Report sought by the Commission had not yet been submitted.
Punjab Police Officials Appear Before Commission
During Monday’s hearing, Harpreet Singh, DSP, and Gulzar Singh, DSP (EO and Cyber Crime), appeared before the Commission on behalf of the Punjab authorities. Sarabjot Singh, son of late Buta Singh and the petitioner in the case, was also present.
The matter stems from alleged remarks made by Warring against Buta Singh during an election campaign meeting in Tarn Taran. The complaint was subsequently taken up by the NCSC.
Five-Day Deadline for Arrest and Status Report
Taking note of the continuing delay, the Commission recommended that the concerned authorities take immediate action, in accordance with law, for the arrest of the accused.
The Punjab authorities have been directed to furnish the status of the action taken to the Commission within five days. The Commission further called for the investigation to be completed expeditiously and the charge-sheet to be filed before the competent court without further delay.
Accountability for Investigation Delay
The NCSC also recommended that the competent authority examine whether any official responsibility lies behind the delay in the investigation and arrest.
If wilful neglect of duty is found on the part of the investigating officer or officers, the Commission said appropriate departmental action may be initiated. This could include consideration of action under Section 4 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
An Action Taken Report on the recommendations has been sought within 30 days.
NCSC Seeks Police Protection for Petitioner
The Commission also raised concerns over the safety of petitioner Sarabjot Singh, citing alleged continuing threats against him.
In view of the circumstances, the NCSC recommended immediate and adequate police protection for Sarabjot Singh and his dependents in both Delhi and Punjab under Section 15A of the SC/ST (Prevention of Atrocities) Act.
Victim and Witness Protection Emphasised
The Commission reiterated that protection of victims, complainants, witnesses and their dependents is an important statutory safeguard under the law.
It directed the authorities to ensure that the petitioner can pursue the case without fear, intimidation or undue pressure, while stressing the need for timely investigation and compliance with its recommendations.
