Jalandhar’s Mariton Hotel dispute has seen a major legal update as police have now removed Section 295A from FIR after an inquiry in the case linked to the hotel clash and alleged religious sentiments issue and according to officials the FIR was earlier registered at Rama Mandi police station against Yashpal Dua, Gulshan Dua, Umesh Dua, Shivi Dua and others after a CCTV video of a violent altercation at the hotel went viral and the case had also included Section 295A of IPC which deals with deliberate acts intended to hurt religious feelings.

Charges under Section 295A dropped

Now after reviewing the matter police have clarified that the section related to “beadbi” or intentional religious insult has been dropped and the investigation found that the incident does not currently meet requirements of Section 295A.

A long running conflict

The dispute is linked to a long-running ownership conflict at Mariton Hotel located on the Jalandhar–Phagwara Highway and the property is jointly owned by multiple stakeholder groups including Paramjit Singh Marwah and Gursimran Singh Marwah, the Kukreja brothers, Kapurthala-based silent partners and the group involving Yashpal Dua.

Escalation of the matter

The tension reportedly began over a 40-marla adjoining land purchase made by majority stakeholders without full consent of minority partners and the land was allegedly meant for hotel expansion and financial steps like bank loan applications were also linked to it while minority partners had objected raising concerns about ownership clarity, possible government land portion and pending electricity dues on the property.

Physical altercation broke out

Earlier the disagreement had been said to be temporarily settled after intervention by local business and political figures however the situation escalated again when a physical altercation broke out at the hotel which was captured on CCTV and widely circulated and following the incident both sides made serious allegations against each other including claims of misbehavior, threats and harassment during a private function at the hotel where one side also alleged religious disrespect which led to the earlier inclusion of Section 295A.
