The Election Commission of India (ECI) has directed the Punjab government to transfer officers connected with the conduct of elections if they are posted in their home districts or have completed, or are due to complete, three years in the same district within the specified period. The directions are part of preparations for the 2027 Assembly elections in Punjab and four other states.

In a letter dated October 27, 2026, the Commission issued instructions to the Chief Secretaries and Chief Electoral Officers of Punjab, Goa, Manipur, Uttar Pradesh and Uttarakhand. The term of the current Punjab Legislative Assembly ends on March 16, 2027.

The Commission has directed the state governments to complete the transfer and posting process for officers covered by the instructions and submit compliance reports by November 30, 2026. The reports must be furnished by the Chief Secretary and the Director General of Police (DGP), along with details of action taken by the concerned government departments.

Officers posted in home districts or for three years to be transferred

According to the ECI's instructions, officers directly connected with election-related work cannot continue in their current revenue district if they are posted in their home district.

The same rule applies to officers who have completed three years in that district during the last four years or will complete three years on or before March 31, 2027, in Punjab, Goa, Manipur and Uttarakhand. For Uttar Pradesh, the cut-off date is May 31, 2027.

While calculating the three-year period, the Commission has stated that promotions to posts within the same district will also be counted. However, service in the state headquarters during the last four years may be excluded from the calculation, even if the headquarters is located within the same revenue district.

Officers transferred to meet the three-year requirement may also be posted at the state headquarters, even if it falls within the same revenue district.

The Commission has further instructed state departments to ensure that officers transferred under these directions are not posted back to their home districts.

District administration, police and transport officials covered

The transfer policy covers a wide range of officials involved in election preparations and the conduct of elections.

These include District Election Officers (DEOs), Returning Officers (ROs), Assistant Returning Officers (AROs), Electoral Registration Officers (EROs), Assistant Electoral Registration Officers (AEROs), deputy election officers and nodal officers assigned specific election responsibilities.

Other district-level officials covered include Additional District Magistrates, Sub-Divisional Magistrates, Deputy Collectors, Joint Collectors, Tehsildars, Block Development Officers and officers of equivalent rank who are directly deployed for election work.

The instructions also apply to Divisional Commissioners, Municipal Commissioners and officials posted in municipal corporations and development authorities.

Police officers responsible for election security and the deployment of police forces are also covered. The list includes senior officers such as Range ADGs, IGs, DIGs, Commissioners of Police, Senior Superintendents of Police (SSPs), Superintendents of Police (SPs), Additional SPs, Deputy Commissioners of Police, Assistant Commissioners of Police, inspectors and reserve inspectors.

However, police officials posted in functional departments such as computerisation, special branches and training have been excluded from these transfer instructions.

The Commission has also extended the policy to officers of the state Prohibition and Excise Department holding the rank of Sub-Inspector or above. Transport Department officials, including Regional Transport Officers, Assistant Regional Transport Officers, District Transport Officers and equivalent field officers of Sub-Inspector rank or above, are also covered.

The ECI has directed that designated positions reserved for officers of a particular cadre must be filled by officers belonging to that cadre, without exceptions.

Police officers cannot return to the same Assembly constituency

The Commission has issued specific directions concerning police officers at the Sub-Inspector level and equivalent ranks.

Such officers cannot be posted in their home districts. If a Sub-Inspector has completed, or will complete, three years in a police sub-division within the specified four-year period, the officer must be transferred to a sub-division outside the same Assembly constituency.

If this is not possible because of the small size of the district, the officer must be transferred outside the district.

The ECI has also directed that District Election Officers, Returning Officers, Assistant Returning Officers and police inspectors or officers of higher rank must not be posted back to, or allowed to continue in, the Assembly constituency or district where they served during the previous Assembly election or any subsequent by-election.

Officials with past election-related charges may not be assigned duties

The Commission has clarified that the policy is not intended to cause large-scale transfers across the entire state administration.

Officials who are not directly connected with election work, including doctors, engineers, teachers and school principals, are generally outside the policy. However, if a complaint alleging political bias or prejudice against such an official is substantiated after an inquiry, the Commission may order the official's transfer and appropriate departmental action.

Sector Officers and Zonal Magistrates appointed for election duties are also outside the transfer policy, but observers, Chief Electoral Officers, District Election Officers and Returning Officers have been asked to monitor their conduct to ensure fairness and impartiality.

Officials against whom the Commission has previously recommended disciplinary action, where proceedings are pending or a penalty has resulted, or who have been charged with lapses in past election-related work, must not be assigned election duties. The same restriction applies to officials against whom a criminal case related to their official functioning is pending before a court.

Officials whose service has been extended or who have been re-employed in another capacity are also barred from election-related work, except those posted in the office of the Chief Electoral Officer.

Officers due to retire by March 31, 2027, in Punjab, Goa, Manipur and Uttarakhand, or by May 31, 2027, in Uttar Pradesh, are exempt from the transfer requirement under the home-district and three-year rules. However, if they hold election-related posts covered by the instructions, they must be relieved of those responsibilities and must not be assigned election duties.

Special rules for ongoing voter-list revision

The Commission has also addressed transfers involving officials engaged in the ongoing Special Summary Revision of Photo Electoral Rolls.

Transfer orders for these officials must be issued and implemented only after the final publication of the electoral rolls, in consultation with the Chief Electoral Officer. The instructions also require the Chief Electoral Officer to be consulted when appointing replacements for officers transferred under the policy.

Copies of all transfer orders issued under these directions must be provided to the Chief Electoral Officer.

Officers must submit declarations

The ECI has directed election-related officers to submit a declaration to the concerned District Election Officer within two days after the last date for filing nomination papers.

The declaration must state that the officer is not a close relative of any contesting candidate or a leading political functionary of the state or district concerned, and that no criminal case is pending against the officer in any court.

If either condition is not met, the officer must provide the relevant details separately. The Commission has warned that a false declaration may invite disciplinary action.

The instructions further state that transferred officers must hand over their charge immediately, without waiting for their replacements to arrive.

The latest directions form part of the ECI's administrative preparations for the next Assembly elections, with the Punjab government required to complete the prescribed transfers and report compliance by November 30, 2026.
